Terms of Service

These Terms are the agreement between you and Tempetto Software LLC (“Tempetto”) for using the Tempetto app and website. By creating an account or using Tempetto, you agree to them — please read them, especially the subscription, arbitration, and liability sections.
The short version

Tempetto is a planning tool for people who visit clients at home — not a medical record system or professional advice.

It starts with a 30-day free trial; a card is required, and it becomes a paid subscription ($19/month) when the trial ends, unless you cancel. You can cancel anytime.

You're responsible for using Tempetto lawfully and for following your employer's rules about client data.

Disputes are resolved by individual arbitration, not class actions — you can opt out within 30 days.
Who we are & accepting these Terms
Tempetto is operated by Tempetto Software LLC (“Tempetto”, “we”, “us”). These Terms are the agreement between you and us for using the Tempetto app and website, and they’re governed by the laws of North Carolina.
By creating an account, starting a trial, or otherwise using Tempetto, you agree to these Terms and to our Privacy & security page. If you don’t agree, please don’t use Tempetto.
Who can use Tempetto
You must be at least 18 years old and able to enter a binding contract.
You may add information about other people (your clients) only if you have the authority and any consent needed to do so.
Your account & keeping your data safe
You sign in with a password, or with a passkey — your face, fingerprint, or device key — where enabled. You’re responsible for your device and for keeping your account secure.
If you forget your password and have no recovery method on file, we may not be able to restore access to your account.
Using Tempetto responsibly
Use Tempetto lawfully. You must have the right to enter any client information you add, and you are responsible for complying with your own legal and professional obligations — including your employer’s or agency’s policies, and HIPAA where it applies to you.
Don’t misuse the service: no reverse-engineering, scraping, reselling or sublicensing access, interfering with the service, or using it to break the law or infringe others’ rights.
A planning tool — not advice or a record system
Tempetto helps you plan a route-smart week. Drive times, routes, and suggestions are estimates — verify them before relying on them.
Tempetto is not medical or professional advice, and it is not your medical record system or a substitute for your employer’s systems or your own professional judgment.
Free trial, subscription & billing
Tempetto starts with a 30-day free trial. A valid payment method is required to begin the trial.
Auto-renewal: when your 30-day trial ends, your subscription automatically begins and your payment method is charged $19 per month (or $190 per year if you choose the annual plan). It then renews automatically each billing period at the then-current price until you cancel. By starting the trial, you authorize these recurring charges.
Cancelling: you can cancel anytime in your account settings or by emailing contact@tempetto.com. Cancelling stops future charges and takes effect at the end of your current trial or billing period; you keep access until then. Cancel before the trial ends to avoid being charged.
Teams plans: Teams are billed per seat — $29 per seat per month, or $290 per seat per year — with a minimum of 2 seats. The organization’s designated billing manager authorizes the charges for all seats. Adding or removing seats adjusts your charges on a prorated basis, reflected on your next invoice. Teams subscriptions renew automatically each billing period at the then-current price until cancelled.
Payments are processed by our payment provider (Stripe). We don’t store your full card details.
Price changes: we’ll give you advance notice before any price change, and it will apply only to billing periods after the notice. Prices exclude taxes, which may be added where required.
Refunds: payments are non-refundable except where required by law (annual plans: refundable within 72 hours of the charge, user must email contact@tempetto.com requesting a refund within the 72 hour window to be eligible for a refund). One free trial per person.
Your data & privacy
How we handle your data is described in our Privacy & security page. In short: your client data is stored in our database, encrypted at rest and access-controlled to your account (or organization, on a Teams plan) — while our routing and AI services still receive only tokens and map coordinates, never names or addresses.
You can remove clients in the app at any time, and you can ask us to delete your account and stored records.
Who owns what
Tempetto — including the app, design, and brand — belongs to us. We grant you a limited, personal, non-transferable right to use it while these Terms are in effect.
The client data and content you enter remain yours.
Other services we rely on
Tempetto uses third-party services — for example Google Maps for routing, OpenAI for some assistant features, Stripe for payments, and Supabase for encrypted storage. Their terms may also apply, and we’re not responsible for third-party services we don’t control.
No warranties
Tempetto is provided “as is” and “as available.” We don’t guarantee that routes, drive times, or schedules will be accurate, or that the service will be uninterrupted or error-free. Tempetto is early-stage software and may change.
Limits on our liability
To the fullest extent allowed by law, Tempetto and its operators will not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or US $100.
Your responsibility to us (indemnification)
You agree to cover us for claims, losses, and costs that arise from your misuse of Tempetto, your violation of these Terms or the law, or your entering data you didn’t have the right to enter.
Ending your access
You can stop using Tempetto and cancel anytime. We may suspend or end your access if you break these Terms or the law, or to protect the service.
Sections that should survive — like the liability limits, indemnification, and dispute resolution — continue to apply after your account ends.
Changes to Tempetto and these Terms
We may update the service and these Terms. If we make material changes to the Terms, we’ll give notice (for example, in the app or by email). Continuing to use Tempetto after changes take effect means you accept the updated Terms.
Governing law & how disputes are resolved
These Terms are governed by the laws of [State], without regard to its conflict-of-laws rules.
Arbitration: you and Tempetto agree to resolve any dispute through binding individual arbitration — not in court, and not as a class action. A neutral arbitrator decides the dispute, and you waive the right to a jury trial and to participate in a class action.
Exceptions: either of us may still bring an individual claim in small-claims court, and either of us may seek an injunction to protect intellectual property or stop misuse.
Opting out: you can opt out of arbitration by emailing contact@tempetto.com within 30 days of first accepting these Terms. If you opt out, disputes go to the courts of North Carolina.
In short: most disputes are handled one-on-one through arbitration rather than court — unless you opt out within 30 days.
